Terms of Service
These terms apply to Tap2Donate, a donation and payment service operated by Tayseerulquran Professional Inc. ("we", "us"). They cover our website at tap2donate.intilaq.host, our donation pages and our Tap2Donate apps. By using Tap2Donate, you agree to these terms and to our Privacy Policy.
1. The service
Tap2Donate lets mosques, charities and community organizations ("organizations") accept donations and program payments. Donations can be made on card readers, tablets and phones, and online. Organizations also get a dashboard for donations, donors, receipts and reports.
2. For donors
- Your gift goes to the organization. We provide the technology. We are not the recipient of your donation and do not decide how it is used.
- Refunds are decided by the organization. Contact the organization if you need a refund or have a question about a payment.
- Tax receipts are issued by the organization, under its own charity registration and responsibility.
- Payments are processed by Stripe or PayPal, and are also subject to their terms.
- You confirm that you are authorized to use the card or account you pay with.
3. For organizations
Your account
- You must be authorized to act for your organization, and the information you give us must be accurate and kept up to date.
- You are responsible for everything done under your account, including by your staff and volunteers. Keep your password and device pairing codes private, and remove access for people who no longer need it.
- Keep devices running Tap2Donate secure. Remove a device from your dashboard if it is lost or stolen.
Payments and fees
- Payments are processed through your organization's Stripe account and, if you use it, your PayPal account. You must accept and follow Stripe's agreements, including the Stripe Connected Account Agreement where it applies, and PayPal's terms if you use PayPal.
- Payment processing fees are charged by Stripe or PayPal. Any Tap2Donate platform fee is agreed with you in advance and shown in your dashboard.
- Your organization is responsible for refunds, disputes and chargebacks on its payments, and for any related fees.
Your responsibilities
- Fundraise lawfully and describe your campaigns, programs and appeals honestly.
- Issue tax receipts correctly and follow the rules that apply to your organization, such as Canada Revenue Agency requirements for registered charities.
- Treat donor information according to privacy law and your own privacy commitments, and respond to donors' privacy requests.
- Card readers and other hardware bought from Stripe are subject to Stripe's own terms and warranty.
4. Acceptable use
You may not use Tap2Donate to:
- collect money for anything illegal, fraudulent or misleading;
- use another person's card, account or identity without permission;
- interfere with the service, test its security without our permission, or access data that isn't yours;
- copy, resell or reverse engineer the service, except where the law allows it.
5. Content
Organizations keep ownership of the content they add, such as logos, campaign names, slides and appeal descriptions. You allow us to host and display that content to run Tap2Donate for you. Tap2Donate itself, including its software, design and name, belongs to us.
6. Availability and changes
We work to keep Tap2Donate available and working correctly, but we cannot promise it will always be uninterrupted or error-free. Payments also depend on Stripe, PayPal, internet connections and device software. We may change or improve the service. If a change significantly affects organizations, we will tell them in advance where possible.
7. Disclaimer
Tap2Donate is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties that are not stated in these terms, including warranties of merchantability, fitness for a particular purpose and non-infringement.
8. Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special or consequential losses, or for lost donations, revenue or data. Our total liability to an organization for any claim relating to Tap2Donate is limited to the platform fees that organization paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.
9. Indemnity
Organizations agree to cover our reasonable losses and costs arising from their fundraising, their content, their tax receipts, their handling of donor information, or their breach of these terms.
10. Suspension and ending
An organization may stop using Tap2Donate at any time. We may suspend or end access if these terms are broken, if required by law or by our payment partners, or to protect donors, organizations or the service. After an account ends, we will keep records as described in our Privacy Policy, and on request we will help the organization export its donation records.
11. Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Disputes will be handled by the courts of Ontario.
12. Changes to these terms
We may update these terms. We will post the new version here with a new effective date and tell organizations about important changes. Continuing to use Tap2Donate after a change means you accept the updated terms.
